help sought with eBay dispute on 2nd woodgrain set

Hi guys---



I'm the sucker who bought http://cgi.ebay.com/ws/eBayISAPI.dll?Vi ... 0346650702



It turns out the that the rules and supplements are well-annotated in pencil and pen, in particular the first GH, but also including the reference sheets, all of the core three rulebooks, and Chainmail.  BM's actually clean, except for the page 46 dungeon map colored in with magic marker.  GD&H is in excellent condition, except for the water damage warping present on the cover that smears the owner's name on the cover sheet and continues through basically to the end of the book (though getting smaller as you proceed through the book).  



I've been trying to work out an amicable return with the seller, given that he clearly didn't describe the books accurately in the Q&A, but he's not willing to do that, he decided tonight.  So, I'll take it to eBay/Paypal/my credit card.



What's my best approach to try to get a full refund on this set?  The seller maintains that because he said the box was only in "good" condition (nearly all of the corners are blown and held together with tape), and that the books were "used" that it doesn't matter that his descriptions were inaccurate.  More specifically that:

Oh man, sorry you got shafted on that one, doesn't PayPal offer insurance on each item, isn't that the big catch for using paypal because you can get your money back if you are not satisfied?

Allan, I was the one who sent the first listed question (Dated the day after the other two though), about wanting bigger pictures.
They were promised and never posted.
Never got any sent to me by E-Mail either.

I got the empression (Right or wrong) that the seller was an old person with little or no experience with photo equipment and computers......

It took a few days to get the response that was posted to the listing.

I think you have a VERY valid argument and I cannot see any way for the seller to argue against your side of this.

Simply put, the dude has no leg to stand on here.
His own written words damn him.....

Obviously, you should KEEP all E-Mails, including those involved in the transaction and the ones involved in your question before the listing ended.

I would Lodge complaints and reversal of charges to all the above (E-Bay/Paypal/Your Credit Card Guys) IMMEDIATELY if not sooner.

No, I think you're right on.  That's the way I read the Q&A, too.
Print out the auction twice, or save a pdf file since the entire response on the Q&A doesn't show up on the main auction page, and then print out your emails to and from the seller before the auction, since you will need to have all supporting evidence when submitted to your credit card company.

I think Paypal requests you open the dispute with them first, then if not to your satisfaction, you can open a dispute with your credit card company.  However, the Paypal thing can drag on, and I think the credit card company needs to have your dispute within 60 days of the transaction (at least I think that my Chase Mastercard is that way).

Hey, I just saved you 1500 bucks :P   I was actually just trying to figure out if it was a famous gamers' copy.... lol.  But, the no, no, no, no crap totally rubbed me the wrong way.  Glad it's evidence for you!  Good luck with Paypal, this should be clear cut Significantly Not as Described.

Hey Allan,

I think you need to open a dispute on Ebay about item significantly different from described.  I believe Ebay charges $25 for this service from the proceeds that will get returned to you.  If it comes to an stalemate then someone at Ebay will step in and decide the claim.

I believe that Paypal provides a similar means to open a dispute but they will not settle anything so it could just leave undetermined.  I think paypal will only force a refund if there is no proof of delivery.

The other alternative is to call your credit card company and say the seller is refusing to accept the refund.  Most credit card companies cover 30 or 90 day returns.

It looks like you paid with credit card. I would contact them and explain the situation. You paid 1500 for a collectable set. The set was in no way as advertised. The seller refuses to accept a return. Find out what you need to do from your credit card company first and how much time you have, what they need in the way of evidence, etc...



Take pictures of everything.



Contact ebay/paypal and tell them the item was Not As Described and you want to return it for a refund.



If paypal will not help and your credit card company will, then file a claim through your credit card company, but I have heard that this can cause problems with your paypal/ebay account.



Try to get it settled through paypal first (if you send it back you will need to be careful how it is sent, tracking, insurance, signature required, etc...)



But make sure you check with your credit card company and keep that in your back pocket as an ace you can drop if you need to.



Sorry to hear about this. This guy goes on my shady dealers list.

Make sure all communication to the seller is done through the official E-Bay system, not via regular email.

Open a dispute via PayPal for SNAD, you have 45 days from the date of sale to do that.  I think with those questions, you have pretty strong standing.

ARRRGH - as I write this I get an outbid notice on that recently posted Bloodstone lot - Dammit!

First off, I do hope you are able to get your money back...
ALL of it.

Second: After this thread and knowing how you were lied to by this seller, and the seller was not willing to make things right.

Once he gets the items back and if he re-lists it on E-Bay.
He may find the bids slow and far between next time.

I have no doubt that it WILL sell again and it might even sell for a similar price as this last time.
But if so, it is unlikely to be an Acaeum member.

I agree with the others.  The "No, no, no and no" is pretty definitive.  The item isn't as described, and you should get your money back.

He's an odd seller.  Looks like he hasn't sold anything since 2005.  And if this is the way he does business, I doubt he will sell much going forward.

All good advice above Allan. I have not done a dispute to that level, but I have disputed a $400 ish purchase.  I would start talking to your credit card company.  In the end, I have had to claim chargebacks through my credit card a few times over the last five years or so - and it is always pretty smooth.  Work with paypal if you can, but don't let the opportunity for your credit card company to refund slip past any arbitrary deadline. They are much more interested in keeping your business than paypal.

The extent of the flaws sounds very much like Fair condition.  Regardless of grading convention, he said there were no marks in the book and there are.  Push for a full refund by all means available to you.

Good luck, Grodog!  We are all pulling for you.

I would agree with the advice given previously particularly with regards to documenting all emails, phone calls, and the auction listing itself with the questions displayed.  Be precise when describing why this item was not accurately represented.  For instance, if the seller claimed no writing, document the amount of writing, type and color of ink or pencil used, and on what pages.  Represent this number as a percentage of the whole, i.e., 87% of the pages were written on in Book1... etc., etc. In my experience, customer service agents typically respond more favorably when you have clearly and overwhelmingly documented the facts of the case with a succinct timeline.

Also, since you tried to settle this amicably and the seller refused, open claims on all fronts in parallel - Ebay/PayPal and credit card company.  Since the auction ended on June 11, you may only have a few more days to initiate a claim with the credit card company.  With Paypal you have 45 days, but I would not wait any longer.  The sooner you get these companies working on this issue, the better for you.  Paypal may take issue with this approach, but your credit card company is more interested in keeping your business and ultimately has more influence.
