Buyer is responsible for all Ebay fees, shipping costs, insurance fee, and tracking fee.


The E-Bay fees part that is...  :?:

Well it is against ebays policies but it doesnt mean that the will enforce it.

It is against, Ebay policy and a report would quickly get the auction removed.  Alternatively, if you won and the fee was expensive, Ebay would probably not penalize you for not going through with the transaction.

I don't know in US, but recent changes in ebay policies allow this. You have now the right to charge the ebay fees (paypal fees as well) to the buyer if you state it in the listing.

It doesn't look like on Ebay.com that you are allowed to charge these fees:

Under "What you're not allowed to charge":

Related fees: Things like gas, mileage, time spent at a carrier, employee wages, or eBay and PayPal fees should not be added.


Also, I found this one interesting:

You're not allowed to say that you're not responsible for item delivery or ensuring that the item is delivered as described. For example, we don't allow statements like "I am not responsible for the item once it's dropped in the mail."

A lot of listing would have to be deleted :D

Very strange that French ebay Policies allow us to add ebay/paypal fees and not the US ebay policies.
France pays des droits de l'homme et du citoyen (at least for the moment...)

I vaguely remember there being a state law (for where Ebay HQ is at in the US) that prevents people charging a handling fee based on the percentage of the win - hough maybe this was just a credit card policy violation or something.

This is the only limitation in French ebay policies. No handling fees based on a percentage of final sale.

Ehm I don't think it covers Internet auction and fixed price sales :)

Anyway; i contacted eBay.it to ask for the exact link stating that asking for ebay fees to buyers it's forbidden. They sent me the usual drone answer  :roll:  about the prohibition of asking for additional fees for 'certain' methods of payment (ie PayPal). But this is not the answer to my questions, so I asked them again.

There is something like a "flou juridique" (I don't know how to say in English). There is no clear statement.

So you can clearly charge ebay paypal/fees but you cannot state that it is linked to a type of payment (in this case, linked to Paypal)
