I'd contact my local police department first, they should be able to direct you in what to do. I'd also Neg him right now and if you haven;t yet, file your Payapl claim.

Oh and by the way, I don't know if you noticed this but Ebay is showing the winning buyer this time as Corwin_1.  I'd strongly suggest that you notify him and let him know what happened to you.

Thanks for the advice, all.

Paypal claim filed.  FWIW, this seller does not know that I know what he's doing.  As of last night he let me know that stuff would ship today...and then he goes and accepts a Buy It Now offer.  Fraudulent :!:

Funnier still the seller has already left me a positive feedback for the transaction.  Either the guy is a criminal genius and come up with the ultimate of ebay scams or he's not very bright.

Can I just ask, if this guy is committing fraud against all these people, why no-one has bothered to leave feedback to highlight the fact to other suckers? Seems like people are only concerned about themselves and not fussed if this guy gets stopped or not? And has anyone spoken to eBay to shut this guy down? Here in the UK I'd be on the phone within the hour. Do you guys in the States not get to call eBay? And why hasn't anyone posted his name and phone number so we can all phone up and ask him about his sale? Whoever is on the end of the line would get pissed off soon enough.

That would be a yes to pretty much all your questions.  I've called both ebay and paypal multiple times, reported the seller, filed the Paypal claim, etc.  I can't speak for the 1st transaction but I did notify the most recent purchaser.  The negative feedback will be left as soon as the claim is finished.  I don't know if it's appropriate to post the guy's phone number in the forum but if anyone really wants it they can PM me.

If I had been ripped off for $1300, I'd be posting the guy's name and address in open forum. I'd also be warning other buyers publicly by posting negative feedback on his page. He'll have that same item listed within a day or so, and no-one will know any better because no-one will post a warning for other buyers. If th guy was a UK seller, I'd be hounding him with innocent phone enquiries about his item for sale. Alas, I'm not gonna go to International Direct Dial rates to harrass a fraudster. But I'm more than happy to kill my free mobile minutes each month phoning up sellers who are trying to screw me.

And the precedence was set long ago with Eastern Treasure Chest, a guy who spent years screwing this community. I may well be one of the only people to have proffited from the guy. We all knew what he was doing. Saw it building. And it happened just the way we all knew it would. His names, addresses and phone numbers were all posted in open forum.

PS. I trust you have your credit card to claim against if all else fails, but them if you don't go to your credit card first, you lose the right to do so later. PayPal will not honour a chargeback if they have already carried out an investigation and found in favour of the seller.

I had a hold placed on one of my first auctions, for something which sold for about $30. The hold was lifted after positive feedback was received. It was an inconvenience since I had stuff I wanted to bid on and not a whole lot in my PayPal account at the time.

Unlike this guy, I actually read the reason for the holding of funds. Sounds like he didn't and figured you were the one trying to rip him off. He's being a jerk because he can't bother himself to read. Sheesh!  :roll:

Of course, I don't have all the details that you do, so I could be off base there.  :)

That sounds like complete bollocks to me.
The guy has sold the same lot to at least three different buyers, for vast amounts of money, from a completely dead account with practically no feedback and none within the last year.
That is indefensible fraud and the the asshole should be sued.

And if he really is so thick that he gets confused by eBay and keeps selling the same lot to all these people over 'misunderstandings' then that is another reason why eBay should check their prospective buyers and sellers for genetic inbreeding and basic IQ levels. The dense among the redneck trailer trash population really screw up things for everyone else.

Never underestimate stupidity. I worked as a bouncer in college and I remember this guys quote when he was hauled before the judge after a barroom brawl. "I was so drunk I didnt know who I hit!" and the judge tells him that is no defense, "But I was drunk?" which seemed perfectly resonable to the guy but didnt save him from the $500 fine.

I know that Paypal mentions they want you to file through them first. Otherwise they won't allow an investigation if you choose a claim through the credit card company first.  But are you saying that the credit card company won't allow an investigation if you choose to file a claim with Paypal first?

I can only speek from the UK perspective, but I'd be willing to bet it's pretty much the same with all financial institutions. If you file a claim with PayPal, and they investigate that claim, and find in favour of the seller (i.e. refuse to give you your money back), then as far as PayPal are concerned the matter has been investigated, the truth accessed and the matter closed. If you then chose to charge back against your credit card, they will dispute the chargeback with your credit card company stating that a full investigation has already been undertaken, and reclaim the money owed from the credit card company. If the credit card company win and you get your money there, PayPal will leave a defecit on your PayPal account and take action to recover the money from you if they can. Foe small amounts it probably just means you lose your PayPal account and they block you from future custom. If PayPal wins, your credit card company give them back the money and go back to you and say they can't recover the funds. Furthermore, under UK law, your transaction between PayPal and your credit card company is a seperate transaction from that between PayPal and the seller, so the service provided by PayPal (the transfer of funds) has been provided in full (which is what PayPal are obliged to provide to the credit card company).
The fact that your goods don't srrive or are faulty is purely a monetary transaction between PayPal and the seller, and PayPal only offer their own buyer protection policy which in the hypothetical situation we're discussing has already been assessed and decided upon.

So if it's a big amount of money, go straight to your credit card. The chargeback automatically initiated the PayPal claim process anyways. You can only really rely on PayPal when you have a cast iron case of failure to deliver.

The purchase I made last week has not been voided.  He refuses to ship unless I leave positive feedback.  He can't access the funds because Paypal has placed a hold on them and he is required to ship prior to the funds being released.

The seller has been reported and hopefully the listing will be taken off.

I did manage to talk quite a bit with Corwin, the second buyer.  It seems there were a bunch of maps missing and they were trying to work things out.  In the end I am very happy that the deal didn't work out.  I think Sanmicus grossly over-estimated the condition of the stuff and the missing map thing would have driven me insane seeing how he proclaimed everything was complete.



I was really disappointed that ebay didn't banish Sanmicus.  The guy made up his own rules as he went along.
