Fuck em. All the guy did wrong was not kill them with the first shot. He's a fool to talk to the authorities without an attorney present.  If they truly broke into his house and went into his basement, I don't have a lot of sympathy for them.  If it comes out he shot them in the street and dragged them inside, that's an entirely different scenario, but i'm not getting that from this report, and forensics should have quickly told them the shootings took place inside the basement and they weren't dragged there from somewhere else.  But if they were in his house with the intention of robbing him, I can't work up a lot of sympathy. He's 64 and they are teens, one who is a wrestler.  I'd be scared also. He has no criminal record, I'd be interested to see if they have one, and for what crimes.

The guy obviously is a lunatic.  But guys, he didn't do this out in the street, he did it inside his own house.  Moral: Don't burglarize or break into the house of lunatics, or those that might be carrying loaded firearms.  If they went and saw a movie that night instead of busting into someone's home, they would still be alive. As for him, he needs to carry a larger caliber weapon so he doesn't have to fire more shots.  It's interesting that if he had killed both teens with one shot to the head, no one would care.  That he was obviously a mental case is what is causing all the outrage here.  This is not the actions of a rational adult, and I wouldn't be surprised if he's mentally all there.  But if I find two teens in my home after hearing them break through a window, they better hope the police get to them before I do, I have a higher caliber weapon and hollow point ammo. I'd shoot them dead.

Of course I'm one that thinks Bernie Goetz deserved a medal instead of jail time.

I had the same reaction you did when I first heard of it. Just deserts, big deal. But the details which have emerged so far paint a different picture, suggesting that the shooter may have spent some time covering up what happened. And yes, there is a forensic investigation, no conclusions reported yet.

We really don't know what happened and there are conflicting reports.

From what I read the man himself is either mentally unbalanced, profoundly stupid or we aren't getting an accurate report. Or a mixture of all three. He supposedly lives alone in a secluded area and has been robbed before. The report I read is that he waited a day and then asked his neighbor to contact the police.

I have no problem with a man killing burglers on his property as long as this wasn't a case of luring them in and then killing them.

Castle doctrine can't turn into "I can kill anybody in my house for any reason". That seems to be what happened here. They were kids, had no weapons of any sort, seemingly didn't even threaten (besides breaking into the house of course), or do anything besides walk down some stairs. What I see happening is you invite the person you want to murder over, shoot them in the chest, walk outside and kick in your own door, break a window, whatever. Then calmly walk back inside and call the cops.

All statements herein are my own opinion. Maybe I see things differently. I own a gun. I'd have no problem shooting a burglar in the chest if they, I dunno, did something threatening. I highly doubt I'd shoot a 17 year old girl in the chest then one under the chin to finish the job. Does she have a gun? Yeah, OK then. Do they see my gun and turn and run outta my house? Just as good.

This whole thing stinks and to say "fuck em" when two people are dead like that, I dunno man. I just don't know.

I've seen the report about telling his neighbor, then other reports which contradict it. That's the rule these days when we can easily read different sources; in the old days we'd read maybe only one source, which would seem authoritative. Now the cracks show.

The most puzzling detail is about the previous burglaries. He was robbed six times within a couple of years, all without telling the police. The seventh time was in October, when he claimed to police that $9,200 in cash & gold coins were taken. If someone is burglarized on multiple occasions within a short span, why leave $9,200 lying around for the thieves to find next?

We don't know if they had weapons or not, but that's immaterial.  If I'm in my basement and hear someone break into my house, the last thing I yell up the stairs is "Hey, you guys got any weapons?"  or "Hey, you guys here to hurt me?  Should I be worried?"  Same logic as all the people who bemoan why cops don't just "shoot people in the legs" when they are coming at them.  Maybe dialing 911 was a better solution in this case, maybe he didn't have a phone downstairs. It's hard to speculate on state of mind of someone alone, old, victimized before.   But the fact remains they were somewhere they shouldn't have been. And now stories are emerging that the boy at least had been in trouble with the law before....for theft.  Any chance maybe he was the one that robbed the man the first time and thought he'd go back for another score?  Do you find it odd the girl went down the stairs after the man of the house already fired two shots?  I did, until I saw someone mention that perhaps she was the lookout, was outside so didn't hear the shots, and went inside to find out what happened to the boy.  I also find it hard to believe she would take a leisurely stroll downstairs otherwise.  It sounds like they knew exactly what they were doing, unless evidence to the contrary is found.

You don't have to do anything but walk down the stairs at at someone's house in the dark after breaking in for most people to shoot you dead, I would suspect.  The fact is this guy went way too far and I wouldn't be surprised at all because of his actions if he had mental issues, but besides the creepy execution method he probably did what anyone else would do in this situation...shoot first.  The fact he killed them the way he did, and didn't call anyone after shooting them speaks more I think to his mental issues than anything else.

Most people don't know that the Castle Doctrine allows the DA to file charges in any case they deem suspicious, as in the scenario you state.  A recent case had a man shoot a young girl and young man dead outside his back door of his house in oddly similar circumstances to this case a few weeks ago in Fort Worth.  In his case, he basically was running a drug house and the two young adults were breaking in to steal drugs or money, they didn't have weapons but they were breaking in his back door when he found and shot them. The DA decided to look into the case because it didn't pass the smell test. Interestingly, the defendant just got himself killed in an argument over drugs a few days ago (irony there I guess, and justice served probably) so that's one trial the tax payers will save money on.   The purpose of the Castle Doctrine is to protect me and you from civil and criminal suits arising out of defending ourselves in our own home and not have to prove proportional force, retreat,  or having to drag the body back inside as cops often told homeowners to if they shot someone on their front porch to avoid prosecution.

It sounds like this guy had plenty of chances to hide the bodies instead of turning himself in, or think of a better story, or contact a lawyer and plead the 5th, so I doubt if he is some criminal mastermind. Sounds more like a confused old man who probably has mental issues, and these young hoodlums made a fatal mistake breaking into his house.  Don't drive drunk, don't do drugs, don't break into the crazy old man down the lane's house.

Because it's his stuff?  If I get burglarized I'm not going to suddenly give all my stuff away so when the burglars come again I can rest safely knowing there is nothing left of mine to steal. Maybe the guy just had cash and gold coins lying around, that's his right, it's his property in his house.  I'm not required by law to place all valuables under lock and key in case a burglar breaks in.

The only reason to tell the police about a burglary is so you can file for insurance. The police make no attempt to find stolen merchandise unless it's right in their line of sight (i.e, they pull over a car at a traffic stop and it's full of microwave ovens).  I've been burglarized twice in my life and the police don't even come over anymore to take a statement.  You just give them a list of items that was taken and that's that, so the insurance company can confirm.  And unless a lot of stuff is taken it's not even worth it to tell your insurance company, cause they'll probably cancel on you or raise your rates.  Probably just got this old guy more and more frustrated every time it happened.

BTW a friend nearby just got burglarized this year. Someone kicked in the front door and stole jewelry, guns and small electronic devices (Ipod, Ipad).   The police told her the MO was consistent with a series of burglaries in her city where a gang of criminals kick in the doors of houses and only steal small items they can resell (avoiding TVs and such for cash, guns and valuables) so they can be in and out in five minutes.  They don't care if the house has an alarm because they are gone so quickly.  She was told the chance she would get back her items, or that they would catch the robbers, was close to nil.

I don't mean from an ethical standpoint, but plausibility. Did the $9,200 even exist? Did any of the prior break-ins actually happen? He's already demonstrated unreasonable actions, so why give his stories any credence at all? By the time the cops arrived, he had cleared away the glass from the broken window & patched it with cardboard, thus destroying the evidence of the supposed Thanksgiving break-in. Did those kids really invade his house, or is it just one more lie to cover his actions?

Sounds like the worst plan of all time...fake some robberies a year in advance...find some innocent young kids driving around in the wilderness....lure them in, kill them....then tell a neighbor about it, and admit he shot them multiple times?  Implausible at best. He sounds to me more like a guy who in his own head didn't believe he did anything wrong, rather than one who was going to conceal a crime, since he did such a terrible job of it.  Remember if he doesn't come forward they still might be looking for the kids, and if he was such a calculating criminal mastermind surely he would have disposed of the bodies instead of telling everyone he killed them. At the very least he would have been advised by an attorney before spewing forth his incriminating confession.

I don't normally comment on these kinds of stories, but I broadly agree with this posting. It is not a contradictory position to hold both; that you may defend yourself at home with force, and also that executing wounded teenagers in your basement is a terrible act.

With less than 3 days to go it looks like the "Turn to 400" kickstarter may not get its funding. Shame I would have liked to see something quality celebrating FF and D&D.
